WRONGFUL DEATH CLAIMS

A wrongful death claim is defined as “the death of a person caused by the conduct or negligence of another.” The claim is not based on damages to the decedent, but rather it is based on the surviving spouse, family members, or even parents. The claim is intended to recover expenses in the absence of the decedent. This includes loss of salary, the value of services the deceased would have provided to the household, the value of the aid and comfort the deceased family member provided, and other factors that place burdens on the surviving family members. Minnesota does not allow for recovery for grief, pain and suffering, and/or sorrow in a wrongful death claim.

To recover compensation, it must be shown that some person or entity was negligent or “at fault” in causing the death of your spouse, child, parent, or other family member

The Statute of Limitations for wrongful death claims is 3 years. This means a lawsuit must be filed or the claim settled within 3 years of the decedent’s death or else a claim will not be allowed
